@um...actually: You missed the part that mentioned packaging materials. That is
where he will be charged with intent to distribute.

While I appreciate his defense of gun rights, I abhor his illegal drug use. Enforce the laws.
However, in many states his possession of all the
marijuana stuff would be perfectly legal, and thus not trigger his possession of
firearms as illegal under that state's laws. The dichotomy between state
laws allowing pot for medical and/or recreational use and apparently not
restricting gun rights; and federal law which still prohibits possession of any
firearm by anyone who uses marijuana in any form has not been resolved.
If proven to be a pot dealer in Utah, then throw the book at him. If merely a
user, then prosecute at the usual low level offense, even though it may trigger
a lifetime firearms ban unless federal law changes.
Do NOT prosecute
differently because he is a gun rights defender, as opposed to someone defending
immigration or abortion rights!

Is it legal to own weapons and possess weed in states where weed is legal?
Unfortunately for Melchior he picked a state that is big on guns, but
doesn't like weed. Then, there is the issue of dealing drugs instead of
just possession.
The Hispanic guy that had a gun and sold a little
weed to an undercover cop ( a few years ago) got 55 years for his
"crime." I wonder how much time this guy will get for grossly exceeding
what the other guy did to "deserve" his 55 year sentence.

So he was found with a pound of weed and a bong, and a bunch of pot smoking
paraphenalia. Yawn. I didn’t read any evidence that he was dealing drugs.
If that surfaces, he rightly deserves a stiff punishment. But in many states
possession of pot isn’t a crime, and therefore the possession of a firearm
with a controlled substance isn’t a felony either. I don’t see a
reason why someone caught with some pot should face multiple felonies and have
all his money and property confiscated. Unless the prosecutor can prove he was
dealing or had an intent to distribute, he should get his property back and be
let off with a misdemeanor and no jail time. It’s a waste of taxpayer
money to lock up pot smokers in expensive jails, this should be saved for real
criminals.

Every responsible gun owner is palm-to-forehead right now. Thanks buddy for
standing up for the 2nd amendment...pretty sure the founding fathers
weren't thinking of protecting your drug trade when they wrote it.

Another responsible Utah gun nut. People that are so over the top with guns
should be monitored regularly. They make responsible gun owners look bad.

So a guy here in Utah went to prison for 55 years because he sold a dime bag of
weed with a gun in his pocket. What do you want to bet this guy gets probation?
