What a horrible series of events. Glad the appeals court ruled the
way they did.
Utah is fortunate to not have this tragic event happen within our jurisdiction.
I don't see that they have a leg to stand on.The children were
only removed from the home because of Steve Powell's pictures of children.
Once Josh moved out of Steve's home, there was no reason (at that point) to
demonstrate a danger to the children. At least not from the perspective of the
Washington authorities; who were only following due process as required by
law.If anyone should be sued, it should be the West Valley Police
Department for allowing Josh to go home to his children after admitting to
taking them camping out in single digit weather and then leaving them alone in
the vehicle. That is where there was probable cause that Josh himself might be
a danger to the children; the Washington case revolved around Josh's
father, and he was no longer with his father, hence the decision for visitation
in his home.
