    Just the latest example of environmental "tort terrorism" to block economic development.

    We need to pass "loser pays" to end this sort of abuse. Of course, the lawyers will object to that because right now the lawyer for both sides get paid regardless, and frivolous suits can be used by deep pocketed plaintiffs just to try to bury the opponent under mountains of legal bills of their own to defend themselves.

    That is why so many companies pay off frivolous claims, as it is cheaper to shell out a few thousand dollars on bogus claims than to spend lots of time in court fighting it. A few companies refuse to play that game and will fight back regardless of cost, but you need really deep pockets to do that.
