A Basque sheepherder accused of hiring a hit man to kill Daggett County Sheriff Gaylen Jarvie has been cleared of charges.

Modesto Mendicoa of Manila was indicted by a grand jury on charges of using interstate commerce to arrange the murder. The indictment alleged he offered a Wyoming man $5,000 to come to Utah and kill Sheriff Jarvie.

Defense attorney Ronald Yengich said charges were dropped because there wasn't enough evidence and because Mendicoa agreed to plead guilty to a third-degree felony for attempting to distribute cocaine charged in 2nd District Court in Weber County.
