SPANISH FORK — A Payson city councilman accused of assaulting two teens who he said were vandalizing his truck has pleaded not guilty and has asked for a jury trial.

Scott Phillips was cited June 16 with two misdemeanors of simple assault after police said he grabbed two teens on May 10.

Phillips told police that the teens, about 18 or 19, were trying to spray paint his truck, and he only grabbed them, but didn't hit them, to get them to stop.

However, Spanish Fork prosecutors told the Deseret News they saw no evidence of graffiti on the truck.

Monday morning, Phillips and his attorney, Gregory Hadley, entered the not-guilty pleas in 4th District Court and asked for a pretrial conference.

Hadley also told the judge he would be requesting a jury trial, a point Judge Howard Maetani told him to bring it up at the next hearing.

Phillips will be in court again Oct. 27.
