A judge has ordered a preliminary hearing for a registered sex offender who has garnered the nickname "Diaper Boy" from police.

Barton Jason Lewis Bagnes, 31, is accused of approaching children and either asking them if they want to see, or simply exposes, a baby diaper that he wears, according to investigators.

In August, Bagnes was arrested and later charged with three counts of lewdness involving a child, all third-degree felonies. Prosecutors say Bagnes entered the East Millcreek Recreation Center, 2230 E. Evergreen Ave. (3435 South), walked through a group of three children to the drinking fountain, and while getting a drink, he pulled up his shirt and partially pulled down his pants to reveal a diaper with Elmo on it.

That incident came just one week after Bagnes was charged in 3rd District Court with 11 misdemeanor counts of lewdness involving a child. Although those charges were filed Aug. 8, prosecutors say they come from an October 2007 incident.

Judge Sheila McCleve has scheduled a preliminary hearing on Oct. 7 for the felony charges. A pretrial conference on the misdemeanor charges is scheduled for Monday.

In 1999, Bagnes was convicted of two misdemeanor counts of lewdness involving a child, according to court records. One of those counts was amended from a felony to a misdemeanor as part of a plea bargain, court records state.

In 2000, he again plead guilty to misdemeanor lewdness involving a child, according to court records.
