OGDEN — A man charged with murder has been ordered to return to the Utah State Hospital after being found incompetent to stand trial.

During an appearance in 2nd District Court on Thursday, court records indicate a judge found that Merlynn David Kilfoyle, 29, remains mentally incompetent to face trial in the May 2000 slaying of John Thomas Rush.

Kilfoyle will remain at the hospital for another 90 days until another review scheduled for June 19.

Rush, 37, was found dead inside an Ogden home from a single gunshot wound to the head. It was originally declared a suicide, but in 2006 police uncovered new evidence that led them to reopen the case and arrest Kilfoyle — a friend and co-worker of the victim.
