TWIN FALLS, Idaho — A Twin Falls gun shop stripped of its federal license by the Bureau of Alcohol, Tobacco, Firearms and Explosives will have a chance to show it did not willfully violate the law.

U.S. District Judge Edward Lodge on Thursday rejected the federal agency's motion for dismissal of the long-running feud with Red's Trading Post.

The BATF stripped Red's of its license last March after an audit found numerous record-keeping violations. Lodge stayed the sanctions after finding the agency had record-keeping problems of its own.

Mark Geston, a Boise attorney representing the gun dealership, says a trial scheduled next month will determine whether the gun dealer willfully violated federal law.
