The man charged with negligent homicide in the death of a teenage boy who fell down a flight of stairs and died while attending a party made a brief court appearance Tuesday.

Victor Hernandez, 47, made an initial appearance before 3rd District Judge Robert Hilder. Hernandez told the judge he was unable to afford an attorney. The court said one would be appointed. His next court appearance was scheduled for Dec. 10.

He was charged with negligent homicide, obstruction of justice, providing alcohol to minors and possession of drug paraphernalia, all class A misdemeanors.

Hernandez was hosting a party at his apartment, 1050 S. 250 East, the night of Nov. 24 through the morning of Nov. 25. Several underage teens attended the party, which included alcohol.

Dillon Whitney, 16, was drunk when he fell down a flight of stairs and died from a head injury. Hernandez called police to tell them a person was lying at the bottom of his stairs. He originally claimed he had never seen the boy before.
