One of two men charged with cutting down a tree that fell on and killed Ogden Fire Capt. Amy Armstrong last year will serve two months in jail.

Second District Judge Parley Baldwin on Thursday sentenced Aaron Locke, 26, to 365 days in jail, but suspended 305 days of the sentence and ordered Locke to spend 18 months on probation after completing his shortened jail term.Locke pleaded no contest in July to negligent homicide, a class A misdemeanor, in connection with the Aug. 12, 1997, incident that killed Armstrong, 34.

Locke's brother, Steven M. Locke, 39, also pleaded no contest but failed to appear for his sentencing Thursday.

Baldwin issued a no-bail warrant for Steven Locke's arrest.

Armstrong, an eight-year veteran and the department's first female firefighter and captain, was killed while driving home through Ogden Canyon.

The two brothers and a teenage relative were cutting down a dead tree on private property about a mile west of Pineview Reservoir, when it fell onto the road, crushing Armstrong's truck.

The owner of a nearby bed and breakfast said he had hired the crew to remove the dead tree so it wouldn't fall onto the road.
