Remember the resident who called police and alerted them to a man putting a shirt over his face and a hat on his head outside a Magna bank?

Detective Keith Stephens said the Salt Lake District Attorney's Office screened the case and decided it didn't meet the required elements of attempted robbery."(They) felt it was either robbery or it wasn't," detective Keith Stephens said. "They didn't feel standing next to the door putting a shirt on over his face and carrying weapons (including a large butcher knife) was enough of an attempt."

Chief Deputy District Attorney Bud Ellett said he personally reviewed the case and felt the man's actions - while odd - didn't constitute a "substantial step toward the commission of the crime."

Ellett said, "I didn't think we could prove anything except that we had a drunk."
