A 31-year-old Logan woman will be evaluated at the Utah State Prison before being sentenced on two charges of second-degree felony rape.
First District Court Judge Gordon Low on Monday delayed the sentencing for Kathy Cain until Nov. 2. The judge ordered that Cain receive a diagnostic evaluation in the meantime.Cain was charged in May with two first-degree felony counts of rape and one count of sodomy, but in June she agreed to plead guilty to reduced charges. She could get up to 15 years in prison for second-degree felony rape.
According to court documents, the rapes occurred after a late-night bout of drinking in April involving Cain and another woman. The woman and her two sons were staying with Cain at the time.
A 15-year-old boy told police Cain approached him during the night while he was trying to sleep. The other boy, 14, said Cain approached him as he was getting out of the shower later that night.
The mother said she remembered Cain waking her up during the night and telling her she had just had sex with her 14-year-old, according to Logan police Detective Rod Peterson.
