Three Carbon County men convicted of rustling cattle from the cousin of Wayne County Sheriff Kerry Ekker will serve one year in jail and each pay $5,000 in fines, a 6th District Judge has ruled.

A jury in January convicted Donald Ray Hatch, 38, and Allen Dwaine Olsen, 31, both from Price, and Mike Payne Warwick, 40, Hiawatha, of felony theft for taking cattle belonging to A.C. Ekker.The men removed the cattle Aug. 29 from a remote location in the Robber's Roost area near Hanksville, deputy sheriffs said. Acting on a tip, authorities apprehended the trio as they left the area.

Judge Don Tibbs also ordered the men to pay restitution for the cattle. He said they may serve their sentences in either the Emery or Sevier county jails.

Tery Menlove, with the Utah Department of Agriculture, said Thursday the 1973 pickup truck, 20-foot stock trailer, two horses and pack equipment used in commission of the crime have become the property of Wayne County.
