A $40 drug debt led to murder in a West Valley apartment complex last summer, with 18-year-old Jake Gallegos fatally shot once in the chest with a .25-caliber handgun.
Micah T. Phillips, 21, Murray, and Sean H. Holgate, 20, West Valley, were bound over for trial on murder and aggravated burglary charges Wednesday in 3rd District Court.Holgate knocked on the door of the Lexington Park apartment where Gallegos was staying on the afternoon of June 25, according to testimony at their preliminary hearing.
When Gallegos answered, Hol-gate stepped aside and Phillips shot him, according to witnesses. The two men fled but were arrested an hour later when they were seen by police driving near State Street and 3500 South.
Sunny Wadley, a neighbor in the apartment complex at 3700 South Lexington and 2300 West, testified Gallegos had been in her apartment earlier that day. He told her he and the two men had argued and fought earlier that week, Wadley testified.
Wadley testified the sound of men arguing awoke her from a nap, then she heard a gunshot.
"When that gun went off, immediately in my mind I knew it was Jake," she testified. "I knew they'd killed him." Wadley testified she heard the distinctive sound of Holgate and Phillips driving away in their Volkswagon Beetle.
The two men face first-degree felony charges of murder and aggravated burglary and are being held in jail on $250,000 bond.
