A judge said Mattel Inc. can sue MCA Records over alleged trademark violations in the hit song "Barbie Girl" by the Danish band Aqua.

Mattel, based in El Segundo, Calif., contends that it did not give MCA permission to use the name of its top-selling toy. Aqua is not named as a defendant.Mattel can file an amended lawsuit seeking damages against MCA, U.S. District Judge Matthew Byrne Jr. said Monday.

Last month, the judge rejected a version of the suit that asked for the immediate withdrawal of all copies of "Barbie Girl" compact discs and videos from stores. In his ruling he said the song was a parody.
