A 22-year-old Utah State University student acquitted last week on the first of five rape charges has been denied bail.
First District Judge Ben Hadfield made the decision Wednesday in the case of Stacey Nelson-Waggoner, who still awaits trial on four more counts of rape and two sexual abuse charges.Nelson-Waggoner's $50,000 bail was revoked in May after a preliminary hearing, and he was immediately jailed. He has remained behind bars since.
Because Nelson-Waggoner was acquitted in his first trial last week, defense attorney Shannon Demler sought to have his client released on bail.
"If the pattern was the same we had in this last trial, Mr. Waggoner's going to walk out of here with six acquittals," Demler said.
Hadfield denied the bail motion. He said he would re-examine the bail issue during a Feb. 25 hearing.
