A woman who claims she was held against her will by Timpanogos Community Mental Health Center has filed notice of claim to preserve her right to file a $200,000 lawsuit against the state.

Attorney and state Rep. Stanley Smedley, R-Bountiful, filed the notice with the Utah attorney general's office and four county commissions on behalf of Penny Dawn Davis, 27.Davis claims she went to Utah Valley Regional Medical Center in Provo to obtain a change in her medication, was held for about 8 hours and then forcibly taken to the crisis unit of Timpanogos Mental Health. The woman's notice claims she was kept for three days in the lock-up facility until her release May 25, 1987.

Davis contends Timpanogos officials, who received Medicaid payment for the time she was kept as a patient, engaged in corrupt business practices and misused public money for their own benefit.

Under state governmental laws, notice must be filed within a year of an alleged incident in a damage claim against the government.
