Payson City Councilman John M. Rogers has been sentenced to a suspended six-month jail term and fined $970 on his conviction for driving under the influence of alcohol, court officials said Friday.
Utah County Justice of the Peace LaMar Horrocks suspended the jail term provided Rogers complete 100 hours of community service under direction of the adult probation and parole office.Horrocks said Rogers' Dec. 3, 1988, arrest for DUI was the second in less than four years. The first resulted in a February 1985 conviction.
"When it is the second DUI, the law mandates the sentence be 10 days in jail, but that will be waived in lieu of 100 hours of community service," Horrocks said.
Horrocks at the Wednesday sentencing granted a defense request to stay execution of the sentence for 30 days. Rogers' attorney, Sumner Hatch, said his client has not yet decided whether to appeal.
