The former manager and vice president of Mountain Oil Co. was sentenced to 30 days in jail and placed on probation for his part in embezzling money from the now-bankrupt company.
Robert Dalton, 54, South Ogden, was sentenced Wednesday by 2nd District Judge David Roth. The judge told Dalton that because he had no previous felony convictions, he would reduce the felony charges to misdemeanors if he did not get into any trouble during his probation. Dalton was also ordered to pay up to $14,000 in restitution.Dalton pleaded guilty April 4 to felony charges of communications fraud and illegal acts by a company director.
John P. Becker, 49, Ogden, was also charged with the same felony charges and he was found guilty of those charges earlier this month. Becker, former bookkeeper of the retail oil company, is scheduled for sentencing on May 8.
During sentencing, defense attorney Glen Richman asked for leniency, saying that justice would not be served if Dalton served time in jail.
"He's suffered enough," Richman said.
