A Phoenix judge has thrown out a $16 million defamation lawsuit filed against "60 Minutes" humorist Andy Rooney for saying a product designed to make rain and snow roll off windshields doesn't work.

U.S. District Judge Robert C. Broomfield on Tuesday ruled that Rooney's comments about Rain-X were his opinion and were thus legally protected.Unelko Corp. of Scottsdale, the maker of the liquid windshield treatment, had sued Rooney over remarks made during a 1988 "60 Minutes" broadcast.

In his ruling, the judge agreed with a statement Rooney made on television after the suit was filed. "This fellow sent me his product to evaluate, and I did," Rooney had said.
