No criminal charges will be filed against a 63-year-old Ogden man who shot and killed an intruder in his apartment because Weber County Attorney Reed Richards said the shooting was justified.

Joseph T. Jones shot and killed Tyrone Boyer, 30, of Roy, last week after Boyer forced his way into Jones' downtown apartment and attacked him.Boyer was shot three times in the chest, once in the shoulder and once in the head with a .22 caliber handgun on Feb. 23.

Police said Boyer was wearing a nylon stocking over his head when he forced his way into the apartment. No weapon was found on the victim, who was pronounced dead at the scene.

"All evidence at this time indicates a justified shooting," said Richards on Friday. "The fellow (Boyer) came in with the intention to hurt him (Jones)."
