Police on Wednesday were deciding whether to seek charges against a Salt Lake security guard who fired three shots during a burglary Tuesday.

The guard, 56, told officers he heard a noise in a semitrailer truck parked outside a business at 175 W. Lucy Ave. (12th South) about 11:30 a.m. He drew his snub-nosed .38-caliber revolver and fired one shot into the ground, demanding the burglar to come out and surrender.The burglar began to run and the guard fired two more shots into the air, said Sgt. Terry Orton. The burglar fled south along the railroad tracks and across 13th South, disappearing into some warehouses. Police believe the burglar entered a business at 1361 S. Third West, asked to use the phone and escaped in a taxi.

Police seized the guard's gun pending an investigation. State law prohibits the use of a firearm except in life-threatening circumstances or when an intruder unlawfully enters a home for the purpose of committing a felony.
