A Duchesne man has been sentenced to five years to life in prison for the shooting death of another man who had tried to intervene in a dispute over a cowboy hat.

Elmer McCrary, 67, was sentenced Monday by 8th District Judge Dennis Draney, who also ordered McCrary to serve a concurrent 1-to-15-year prison term for attempted murder.McCrary fatally shot Larry Mortensen, 42, of Duchesne, and attempted to kill Sandra Burnett, 37, of Hanna, during an April 29 incident at the Commercial Club bar. Mortensen was shot when he attempted to break up an argument between Burnett and McCrary over a cowboy hat the defendant had given her.

McCrary initially was charged with first-degree murder, but pleaded guilty last month to second-degree murder as part of a plea-bargain agreement.
