A polygamous family that was blocked in its attempt to adopt six children has appealed the judge's denial to the Utah Court of Appeals.
St. George attorney Steven Snow filed the notice of appeal earlier this week in 5th District Court on behalf of Vaughn and Sharane Fischer, a polygamous couple from Hildale, Washington County.That appeal had not been received Thursday at the state appeals court.
The Fischers had been seeking to adopt the children of Brenda Johanson Thornton, who died of cancer in 1987 two months after becoming Fischer's third wife.
Brenda's two sisters and her father, who are not polygamists, opposed the adoption petition, claiming that polygamy is illegal and immoral and therefore not a proper environment in which to raise children.
District Judge Dean Conder agreed, denying the adoption petition. But Conder allowed the Fischers to retain temporary custody of the children pending an appeal of his decision.
Vaughn Fischer is also married to Katrina Stubbs.
