A Clearfield man was sentenced to three concurrent prison terms on sexual abuse and pornographic materials charges Tuesday in 2nd District Court.

Frank E. Padilla, 34, 143 W. 650 North, was sentenced to two concurrent one-to-15-year prison terms for sexual abuse of a child and a zero-to-five-year term for dealing in material harmful to a minor.He was originally charged with two counts of aggravated sexual abuse of a child, each a first-degree felony carrying a prison term of five years to life and a minimum mandatory term of three, six, or nine years.

He pleaded guilty to the reduced sexual abuse charges, each a second-degree felony, and the third-degree felony charge of dealing in pornographic material.

The incidents occurred in October 1987 and April to May of 1988, according to court records, and involved a 7-year-old girl.

Defense attorney Glen Cella asked Judge Douglas L. Cornaby for jail time, rather than prison time, for his client, probation, and continued therapy and alcohol counseling. He argued Padilla had suffered abuse, his wife had been abused, and now his son is showing similar behavior patterns.

The cycle of abuse needs to be broken, Cella told Cornaby, but with therapy instead of prison time.

But the judge, citing the frequency and extended time period of the abuse incidents, said therapy programs are available in the state prison and ordered Padilla to begin serving the terms immediately.
