A former Duchesne County school teacher has been acquitted of felony attempted rape and forcible sexual abuse charges, but the eight-member jury found him guilty of three misdemeanor counts in an April 3 party involving two teenage girls.

A five-woman, three-man 8th District Court jury deliberated slightly more than one hour Tuesday evening before returning the verdicts against Brian Clark, 35. The jury found him guilty of misdemeanor counts of supplying alcohol to a minor, contributing to the delinquency of a minor and unlawful sexual intercourse. Sentencing was set for Jan. 9.Clark was a band instructor at Roosevelt Junior High School at the time of his arrest last April.

Defense attorney Robert Van Sciver said the 15-year-old victim never refused the advances of her ninth-grade teacher in his car during the early morning hours of April 3. He said although she had been drinking, she still was a willing participant.

Earlier, co-defendants Melvin Gunville, 35, and Arlo McKee, 39, pleaded guilty to similar charges. Gunville pleaded guilty in the rape of a 17-year-old victim and McKee pleaded in the rape of the 15-year-old student.

Gunville is serving a one-year term in the Duchesne County Jail and McKee is undergoing a 90-day psychological evaluation.
