An Ogden man was ordered to remain in jail until his trial because he failed to comply with a court order prohibiting him from seeing the woman whose child he is charged with killing.
Frank L. Archuleta, 29, was free on a $10,000 bond. He is charged with second-degree murder in the death of Preston Sherman, 2, Ogden.Archuleta was jailed last week after he was found staying with the victim's mother, Nancy Delgado, who recently gave birth to Archuleta's child.
Second District Judge David Roth Wednesday told Archuleta he would remain in jail until his trial, which is scheduled to begin next Tuesday.
Prosecutors said that Archuleta beat the child to death last August, after repeated abuse.
The defendant has waived a jury trial, and testimony will be presented before Roth.
