Second District Judge Rodney Page has ruled in favor of a 73-acre Layton annexation, declaring a 1979 consent agreement between Clearfield and Layton void.

Clearfield officials in July filed a protest against the proposed annexation of the site, planned for a 330-home development, based on the nine-year consent agreement between the two cities.That agreement called for a written response from the Clearfield City Council prior to any land annexation taking place in certain areas.

But Page ruled the agreement invalid, saying one council cannot bind the action of a future council.
