Members of a former Clearfield family who said they were held at gunpoint after drug-enforcement officers broke into their home on a misdirected drug raid last February has filed suit against the Weber-Morgan Narcotics Strike Force and other associated agencies.
In their 2nd District Court suit, Fred and Judy Beard said they suffered physical and psychological problems after the officers violently entered their home at 1:30 a.m. on Feb. 7, beat Fred Beard to the ground and held guns on Judy Beard and the couple's three children.The officers actually had a warrant not for the Beards but one of their neighbors, who was arrested immediately following the incident.
In addition to the strike force, the suit names as defendants Roy City, the Weber County attorney's office and the Davis County sheriff's office. The Beards ask that damages be determined by the court.
The Beards, who now live in Bountiful, were awakened by pounding at their door, says their Ogden attorney, Dan Wilson. Arming himself with a .22-caliber handgun, Fred Beard went to the door and called out, "Who's there," the suit says.
When someone replied, It's Doug, it's important!," Fred Beard believed it was his neighbor and opened the door slightly. The door was then forced all the way open, Fred Beard was knocked back and then beaten and kicked in the genitals, the suit alleges.
The suit further charges that the officers, who were not in uniforms and did not immediately identify themselves, then proceeded upstairs where Judy Beard and the couple's children had been sleeping. Judy Beard hid in her closet, only to be ordered out by three men holding guns on her, the document said.
The men drew guns on the children while their room was searched, as Judy Beard fainted in her room, the suit said. The intruders finally identified themselves as law officers, and left without calling for medical care or apologizing, the suit adds.
Fred Beard was treated at St. Benedict's Hospital for multiple abrasions and contusions, and his diabetic condition has worsened from the trauma, the Beards charge.
