An Ogden man will stand trial Nov. 4 for the beating death of his girlfriend's 2-year-old son.
Frank L. Archuleta, 29, pleaded not guilty to a second-degree murder charge before 2nd District Judge David Roth on Monday.The man is accused of beating to death Preston Sherman on July 31 in his Ogden home.
State Medical Examiner Todd Grey testified during a preliminary hearing earlier this month that the toddler died from battered child syndrome - gradual child abuse.
He said that the body had old and fresh bruises, along with internal bleeding and burns.
Archuleta was arrested after the autopsy was performed. He remains free on a $10,000 bond.
The victim's mother, Nancy Delgado, said she was living with Archuleta when her son died. She said Archuelta had been ordered from the house by a juvenile court judge because of pervious abuse on the child.
She testified during the preliminary hearing that despite the court order Archuleta moved back in with her and her son in early July.
Delgado said she now is living with the defendant and is pregnant with his child.
