Two brothers accused of ordering their pit bull to attack a police officer pleaded not guilty to assault charges Friday and were ordered to stand trial Oct. 17.

Troy Randy Montoya, 225 S. 15th West, pleaded not guilty to one count each of aggravated assault, a third-degree felony, and one count of assault on a peace officer, a class-A misdemeanor.Franklin Jeff Montoya, 27, 1794 W. Fourth North, is charged with assault on a peace officer.

Dave Hendricks, a Salt Lake City police officer, was investigating a report of gunshots on July 30 when Troy Montoya ordered the dog to attack him, then hit the officer in the face, according to a probable cause statement. Hendricks shot the dog in the head with his service revolver, killing it, as the animal charged him.

The statement also accuses Franklin Montoya of hitting Hendricks in the face.
