A Salt Lake man accused of robbing and killing a Circle K clerk pleaded not guilty to the charges Monday.
Ernest Gabriel Hernandez, 26, pleaded not guilty to first-degree murder, a capital offense, and aggravated robbery, a first-degree felony, before 3rd District Judge Anne Stirba. But Stirba, who was just recently appointed to the bench, recused herself from the trial stating that she had a very full schedule.The capital case was reassigned to Judge Scott Daniels. A trial date has not yet been set.
Hernandez is charged with shooting Tod J. Menuey, 26, of Salt Lake City, in the head during a robbery on Jan. 23. A video camera took photographs of a man moments after the shooting. The man was wearing Menuey's smock that he had been wearing minutes earlier.
