A former South Summit art teacher has waived his preliminary hearing on charges he sodomized a 14-year-old boy at a St. George motel.

Francis Everett Nichols, 44, Oakley, was bound over Tuesday to 5th District Court by Circuit Court Judge James Shumate on a charge of forcible sodomy, a first-degree felony, and a third-degree felony count of dealing in harmful material to a minor.The charges stem from an incident Feb. 2.

Nichols is scheduled for arraignment May 13 at 9:30 a.m.

The judge said Nichols could remain free on his own recognizance despite objections by Deputy Washington County Attorney Brent Langston.

Nichols faces similar charges in Summit County, where officials allege he showed students pornographic movies and attempted to fondle a 14-year-old.

During an appearance in that case, defense attorney Ron Yengich said his client intends to plead guilty to a single count of dealing in harmful materials in Summit County. He faces arraignment in that case April 15.

He also is expected to plead guilty to a count of second-degree felony attempted forcible sodomy in Washington County.
