Convicted killer James Louis Holland on Thursday told the judge who sentenced him he does not want to appeal his conviction.

It appears the statement does little more than add to his court record as state statute requires the Utah Supreme Court to review all death sentences.Third District Judge Homer Wilkinson set April 10 as the date Holland is to die by lethal injection for killing 70-year-old Florida resident Samuel Patt, whose body was found off I-84 near Echo Reservoir.

Still to be decided is whether state prosecutors or Holland's attorney will set the mandatory appeal in motion - and when. "We owe it to the people out at Corrections not to go right up to the 9th to make sure they don't prepare for an execution that isn't likely to happen on the 10th," said Assistant Utah Attorney General Sandra Sjogren.
