A new trial date has been set for Payson City Councilman John "Mike" Rogers in 4th Circuit Court for driving under the influence of alcohol.

Rogers, 49, is scheduled to stand trial April 16 at 9 a.m. He pleaded not guilty to the charge on Oct. 23 and had a trial date set for Jan. 30. However, that date was continued while the court considered motions filed by Rogers' attorney, Robert Van Sciver.Rogers was arrested Oct. 4 near Payson Canyon after being stopped by a Utah County sheriff's deputy for undisclosed reasons. Because Rogers refused to take a breath test, the Drivers License Division suspended his driving privileges on Nov. 7. In December, Rogers filed a petition in 4th District Court requesting his driving privileges be restored. Judge Cullen Y. Christensen denied the petition Feb. 8 and set a hearing on the matter for March 1.

This is the third time Rogers has been charged with drunken driving since 1984. He was convicted in February 1985 and again in February 1989. He faces a minimum 10-day jail sentence if found guilty and could be sentenced to six months in jail and fined $1,000.
