Preliminary hearing has been set for Feb. 26 for an art teacher accused of showing pornographic videos to three students and attempting to fondle one of them.

Franc E. Nichols, 46, who teaches at South Summit middle and high schools, was arrested at the middle school Monday, said Summit County Attorney Robert Adkins.The Oakley man was charged with three counts of dealing in harmful materials to a minor, third-degree felonies, and one count of attempted aggravated sexual abuse, a second-degree felony.

Nichols was arraigned Tuesday before Judge Edward Watson, who set the preliminary hearing.

Nichols is charged with showing pornographic videos to three male students last week, two of them age 14 and the other age 13, and attempting to fondle the 13-year-old.

The complaint said two of the youths said the defendant also had displayed books or magazines showing homosexual and heterosexual intercourse.

Blake Ostler, an attorney for the South Summit School District, said Tuesday that Nichols was suspended without pay and given notice of termination effective Feb. 18.

The charges carry penalties of one to 15 years for attempted sexual abuse and zero to five years for dealing in harmful materials.
