The trial date for Payson City Councilman John Michael Rogers in 4th Ciruit Court has been continued while the court considers motions filed by Roger's attorney, Robert Van Sciver.
Rogers' trial on a charge of driving under the influence of alcohol was scheduled to begin Wednesday. A pre-trial hearing has been scheduled for Feb. 14.Rogers was arrested Oct. 4 by a Utah County deputy sheriff near Payson Canyon. The officer said he had reason to believe Rogers had been drinking. Rogers refused to take a breath test and later had his driving privileges suspended by the state Drivers License Division. Last month, Rogers filed a petition with 4th District Judge Cullen Y. Christensen to have his driving privileges reinstated. Christensen has yet to rule on the petition.
Rogers has two previous drunken driving convictions. If found guilty, he faces a minimum of 10 days in jail and could be sentenced to six months in jail and fined $1,000.
