An Orem man was sentenced Friday in 4th District Court to at least 10 years in prison for two counts of sodomy on a child, first-degree felonies.
David Jeffery Brown, 26, pleaded guilty to the charges in December. Brown was originally charged with six counts of sodomy on a child for incidents that took place in June 1985.Brown underwent a mental evaluation at the Utah State Hospital, and doctors determined he suffered a diminished mental capacity but was competent to proceed. Brown's attorney, Gary Weight, said his client's mental capacity is that of a 14-year-old. Judge George E. Ballif said Brown's condition does not qualify him for involuntary hospitalization.
Prosecuting attorney Jim Taylor said Brown, because of his mental condition, would be difficult to rehabilitate and is a risk to repeat his actions. Weight asked that Brown be sentenced to a five-year minimum sentence, and the presentence report recommended a 15-year minimum sentence. Ballif sentenced Brown to 10 years to life in prison.
