A judge on Tuesday put off sentencing a Vernal man convicted of attempted manslaughter in the shooting of his 17-year-old stepson.
Eighth District Judge Dennis Draney instead ordered Charles Montgomery, 56, to undergo a 90-day psychiatric evaluation at Utah State Prison.Draney said he had considered just sentencing Montgomery to a year in the Uintah County Jail but decided to order the evaluation prior to final sentencing April 23.
Montgomery was convicted Dec. 4 by an eight-member jury following a two-day trial. He was charged in a November 1989 incident in which his then-stepson, David Bailey, was shot once in the chest with a .22-caliber handgun.
Police said the shooting occurred following a daylong argument that included a fist fight.
