A Daggett County man has agreed to voluntarily leave the country rather than spend time in jail for trying to buy cocaine from undercover officers.

Modesto Mendicoa, 50, Manila, and a native Basque, appeared for sentencing before 2nd District Judge Ronald O. Hyde. He had been charged with attempting to buy $15,000 worth of cocaine from police in downtown Ogden earlier this year.He was also convicted in Green River, Wyo., of cattle rustling, and he received a prison term of from three to five years. He is free on that conviction pending appeal.

Mendicoa was also accused of hiring another person from out of state to travel to Utah to kill Daggett County Sheriff Gaylen Garvie last fall. U.S. prosecutors agreed to drop that charge against the defendant in exchange for a guilty plea to the Ogden drug charge.
