Results of an autopsy will determine if Weber County Attorney Reed Richards will file more charges against a Roy couple accused of burying their 5-year-old son in their back yard.
Richards said Tuesday that he was still awaiting official results from the Utah Medical Examiner's Office to determine the cause of death of Nicholas McGuire.Deborah Thomas, 28, and the boy's stepfather, James Thomas, 30, have both been charged with the third-degree felony charge of abuse or desecration of a human body. The couple is scheduled to enter a plea to the charge Friday in 2nd District Court.
McGuire's body was found wrapped in garbage bags and buried in the back yard Dec. 17, and the arrested and booked into the Weber County Jail, where each remains on $35,000 bond.
The criminal complaint charges that the mother and stepfather buried the boy between Nov. 11 and Nov. 16.
"We may not file more charges against them," said Richards. "We're still awaiting the results of the autopsy before we proceed."
