Ben Atene Jr. will be retried starting 9:30 a.m. Oct. 11 on charges he murdered Navajo Tribal Officers Roy Lee Stanley and Andy Begay.

U.S. District Judge J. Thomas Greene set Atene's new trial Monday during a scheduling conference. Atene is the only man whose case is unresolved, among four men originally accused of killing the officers.After the jury was unable to decide on Atene, Greene declared a hung jury.

During the trial, Greene dismissed charges against Marques Atene when the government admitted it did not have enough evidence against him for a conviction. Vinton Bedoni and Thomas Cly were found guilty of first-degree murder and weapons charges. Their sentencing is set for 8 a.m. Oct. 3.

The officers were killed the night of Dec. 4-5, 1987, when they stopped separately to investigate an illegal beer party near Monument Valley, on the Utah side of the Navajo Reservation.
