A Roy couple are being held in Weber County Jail on a charge of improperly disposing of a body in connection with the death of a 5-year-old boy.

The body of Nicholas McGuire was found buried in the couple's back yard about 5:45 p.m. Monday.County Attorney Reed Richards said Tuesday that Debbie and James Thomas, the victim's mother and stepfather, will be arraigned Wednesday morning on the third-degree-felony charge in 2nd Circuit Court. Richards said more charges could be forthcoming pending results of an autopsy.

A press release from the Roy Police Department says police received a tip from Marion, Iowa, on Sunday that a 5-year-old boy had been reported missing and his mother lives in Roy.

However, Marion Police Capt. Joe Neuhaus said Tuesday that the boy was not from his city and he doesn't know the victim's hometown. "He was not missing from our city," Neuhaus said. "The kid is not from Marion, Iowa."

Roy Police said the boy's body was taken to the state medical examiner's office for an autopsy. Police Chief M.J. Hammon refused to release further information.
