A Vernal man has been found guilty of attempted manslaughter in the shooting of his 18-year-old stepson.
Charles Montgomery, 55, had been charged with attempted murder in the Nov. 30, 1989, shooting of David Bailey.Prosecutors said the two had been involved in a fist fight before Bailey was shot in the chest with a .22 caliber pistol.
Deputy Uintah County Attorney Alan Williams said Montgomery should be found guilty of attempted murder rather than attempted manslaughter because his actions were premeditated.
In closing arguments, Williams said the bullet missed Bailey's heart by only one inch.
"He had plenty to time to cool down," Williams said.
Defense attorney Harry Souvall said Montgomery was protecting himself when the shot was fired. He said his client had been "beaten bloody" by Bailey.
The 8th District Court jury deliberated an hour and a half before delivering the verdict. Judge Dennis Draney set sentencing for Jan. 8.
