Payson City Councilman Mike Rogers, who was arrested on Oct. 4 and charged with driving under the influence of alcohol, will have a pretrial hearing Tuesday in Spanish Fork's 4th Circuit Court.
Rogers entered a not-guilty plea on Oct. 23 by way of a letter to the court from his attorney. At the hearing motions will be heard and a trial date is expected to be set.This is the second time Rogers has been charged with driving under the influence in the last two years and the third time since 1984. Rogers was convicted of drunken driving in February 1985 and again in February 1989.
Driving under the influence is a class B misdemeanor punishable by six months in jail and a $1,000 fine. Since Rogers has a drunken-driving conviction within the past five years he faces a minimum 10-day jail sentence if found guilty.
