A federal judge plans a Dec. 4 hearing on a lawsuit by 45 House Democrats seeking to bar President Bush from ordering an attack on Iraq without congressional approval.
U.S. District Judge Harold H. Greene on Wednesday gave the government until Monday to file its response to the lawsuit. The judge said he would hear arguments Dec. 4 on the lawmakers' motion for a preliminary injunction.Greene, a liberal Democrat appointed by President Carter, rejected the Justice Department's motion to transfer the case to U.S. District Judge Royce C. Lamberth, a former government attorney appointed by Reagan. Lamberth is considering a separate challenge to the president's war-making powers by Sgt. Michael R. Ange.
