A 25-year-old Provo man has been ruled competent to stand trial on charges of sodomy and rape of a child.

Patrick S. Burt, Provo, is one of five men charged with sexual misconduct involving a 13-year-old girl who has reported incidents with about 30 men and boys.In testimony at a competency hearing before 4th District Judge Boyd L. Park, two doctors agreed Burt could understand the charges and penalties he faced, but they disagreed about his ability to aid in his own defense.

Dr. A. James Morgan, a psychiatrist at Utah Valley Regional Medical Center, said Burt suffered brain damage in a 1981 skateboarding accident that has impaired his social judgments.

Morgan said Burt cannot understand abstracts such as justice and fairness and cannot aid in his own defense because of that.

Dr. C. Jeff Groesbeck did not agree that Burt's problems with making social judgments interfered with his ability to help his attorney.

He also said that even though Burt does not remember some incidents, that should not impair his ability now to deal with the situation.
