Juab County commissioners voted two to one in favor of withholding the October paycheck of Lane Harward, Nephi precinct justice court judge, until he meets with commissioners.
The check totals $1,670.Commissioner Jim Garrett made the motion to withhold the paycheck until Harward documents for commissioners that he has not abandoned his office.
Harward will be asked to meet with commissioners Nov. 5. Commissioners say they've received reports accusing Harward of working only one day in 60. There is also some question about whether Harward still resides in Utah.
Harward, who was elected, will be affected by a new state law that mandates the commission appoint a judge to fill the position. The law takes effect Jan. 1, 1991. Recently, Harward met with commissioners and informed them he would be interested in retaining the position in January.
