A judge ordered 14 black lawmakers to stand trial on trespassing charges for trying to take down the Confederate battle flag flying over the state Capitol, rejecting their claim of legislative immunity.

District Judge Craig Miller on Wednesday scheduled a Sept. 9 non-jury trial for the legislators, who are charged with second-degree trespassing, a misdemeanor.Miller said the issue of free speech raised by the lawmakers in connection with their Feb. 2 protest at a fence around the Capitol would have to be settled at the trial.
