A judge has been named to hear the case against Daggett County Attorney Wayne Searle, who faces charges of drunken driving, failure to report an accident, theft and use of stolen license plates.

Second Circuit Judge Brent West of Ogden will hear the case in Manila's 8th Circuit Court, scheduled to begin Oct. 24. He replaced 8th Circuit Judge A. Lynn Payne, who recused himself.West was named this week by the state court administrator's office.

Searle, 45, has pleaded innocent to the charges, all class B misdemeanors, and remains free on his own recognizance.

The prosecutor is charged with driving while intoxicated on Sept. 13. At that time, he allegedly swerved of Highway 43 through a fence, returned to the road and drove home.

County sheriff's deputies followed the car to Searle's home, but he reportedly wouldn't answer when they knocked. The deputies contacted the Utah Highway Patrol due to the potential for conflicts of interest, and Searle was pulled over and arrested by troopers after leaving his home two hours later.

Searle later was charged with stealing license plates and using them on his vehicle.
